Do you wonder about your rights and responsibilities with regard to the protection of a client’s information when you are called upon by the court to produce clinical records or give personal testimony?  When might a therapist be compelled to disclose clinical information via records or testimony?  What parts of a client’s record are protected by statute?  Under what circumstances may private health information (PHI) be legally shared?  If you have every wondered about any of these questions this workshop is for you.  Robert G. Madden, LCSW, JD, Professor at the University of Saint Joseph, practitioner, and experienced presenter, will cover the basic legal issues clinicians encounter routinely, starting with an overview of topics such as mandated reporting, medical records laws (i.e. HIPPA), confidentiality and privilege, professional negligence/malpractice, releases of information and redaction of records.  Legal principles that apply to clinical record keeping will be reviewed including current legal and ethical guidelines that support a standard of care to reduce the risk of liability and ensure quality practice.  The workshop will address the different court systems–Probate, Juvenile, Criminal– in the afternoon session, tackling some more challenging issues such as subpoenas, testifying in court, being in an adversarial position, and presenting a case effectively.  Don’t miss the opportunity to have this essential legal information be a part of your clinical practice.
